An accusation of domestic violence is very serious. The state can pursue formal charges against a person accused of domestic violence even if the alleged victim refuses to do so. It can be at the sole discretion of the prosecution to decide whether formal charges will be filed. Cases of domestic violence often include a restraining order or an order of protection. This means that the accused individual may not come within a certain distance of or contact the alleged victim. This could mean that you have to move out of your own house if you share the residence with the alleged victim.
